Minor Land Division

Ordinance 2005-34
In March 2005, Pima County introduced ordinance 2005-34, mandating that landowners secure a Minor Lands Permit (MLD) before legally splitting their land. This ordinance is aimed at regulating land splits to ensure proper documentation and compliance with county regulations.
Requirements for Land Splits
The ordinance specifies that any land split must include a sealed survey that clearly depicts boundary lines, existing structures, legal access, and utility easements for each of the lots involved in the split. This requirement ensures that all relevant details are accurately recorded and available for review.
Legal Access Documentation
A preliminary title report must be submitted alongside the sealed survey. This report is crucial as it demonstrates that each lot has legal access from a public right-of-way, ensuring that the new lots created are accessible and in compliance with legal standards.
Limitations on Lot Splits
The ordinance also imposes a limitation on the number of lots that can be created through an MLD, capping it at a maximum of five lots. This restriction is intended to control development and maintain orderly growth within the county, preventing excessive fragmentation of land.
